Helping Our Music Evolve, Inc. (doing business as HOME, and herein referred to as "H.O.M.E.", "we", "our", or "us") offers a shared, community-driven workspace for musicians and music industry professionals. It exists because of you and for you. As a member, you will not just be a customer of H.O.M.E.; you will be an active part of what H.O.M.E. is and does for you and for others. You will have special privileges within H.O.M.E. designated workspaces ("Facilities") and associated activities.

Before finishing your H.O.M.E. membership application, please read the following terms of service ("Terms") carefully. If you, the user, ("you", "your", or "Member") agree to these Terms, please go back to the previous page and complete your application. This will constitute a binding agreement between you and H.O.M.E. Please note that any violation of these Terms may result in termination of the H.O.M.E. membership and any service to you.

Description of Service and Levels of Membership

H.O.M.E. currently provides registered and paid members with access to a number of on-line, in-person, and physical resources, including but not limited to written articles, videos, resources, tools, production facilities, coworking space, and member programming via HOME for Music (an affiliated 3rd Party "Website") and designated H.O.M.E. workspaces (collectively, the "Service"). Unless expressly stated otherwise, any new products or features added to the current Service will be subject to these Terms. H.O.M.E. provides this Service solely to individuals and companies who are working within the music industry and has no obligation to provide it to any other parties.

H.O.M.E. offers different levels of membership for your Account to help meet your needs. The level of membership you purchase will provide you with different opportunities and access to our locations and facilities. For full details, please visit https://www.homeformusic.org/memberships.

General Terms and Conditions

Privacy Policy and Our Creative Environment

H.O.M.E. is committed to maintaining your privacy. Your Registration Information and any other information about you or your Account is subject to the terms of H.O.M.E.'s privacy ("Privacy Policy"), which can be found at http://www.homeformusic.org/privacy. The Privacy Policy is hereby incorporated into these Terms by reference.

Fees and Billing

Fees. The current fees for the Service ("Fees") can be found at https://www.homeformusic.org/memberships. If the Service you have selected in your registration requires payment of a Fee, you agree to pay such Fees promptly, along with any applicable taxes. We reserve the right to change the Fees at any time, provided, however, that we will not change the Fees we charge you during your current subscription.

Billing. You are responsible for any and all charges to your Account. If you have any questions about charges to your Account, you should contact H.O.M.E.'s customer service department at support@homeformusic.org. All charges will be considered valid unless disputed in writing within thirty (30) days of the billing date.

Auto-Renewal. At this time, all accounts are auto-renewing, meaning that we will automatically renew your membership and bill your credit card on the anniversary (monthly or yearly) of your most recent membership registration.

Termination

You or H.O.M.E. may terminate or cancel your Account at any time. If you have prepaid any Fees for your account and your Account is later terminated or canceled for any reason, we will not provide any refunds or credits to you.

Termination by Member: You may cancel your Account or any part of the Service with 30 days notice. If you cancel or terminate your Account, cancellation will become effective upon the expiration of your membership subscription term, or immediately if you so choose. Indemnification

You agree to indemnify, defend, and hold H.O.M.E., and its subsidiaries, affiliates, officers, agents, contractors, licensors, co-branders or other partners, and employees, harmless from any and all suits, actions, losses, claims, proceedings, demands, expenses, damages, settlements, judgments, injuries, liabilities, obligations, risks, and costs, including, without limitation, reasonable attorneys' fees, made by any third party due to or arising out of your User Generated Content, your use of the Service and/or Sites, your connection to the Service, your violation of these Terms, your breach of any warranties in these Terms, your violation of any law, rule, or regulation, and/or your violation of any rights of another.

DISCLAIMER OF WARRANTIES

You expressly understand and agree that your use of the service and sites is at your sole risk. The service is provided on an "as is" and "as available" basis. H.O.M.E. expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

LIMITATION OF LIABILITIES

You expressly understand and agree that H.O.M.E. shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, whether based in contract, tort, strict liability or otherwise, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

Online Terms and Conditions

Use of Member Account

You are the authorized user of your HOME For Music Account and must comply with these Terms. You must keep your password confidential so that no one else may access the Service through your Account. Anyone with knowledge of or access to your Account password can use that information to gain access to your Account.

Member Content

You, and not H.O.M.E., are solely responsible for all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials uploaded, posted, displayed, or otherwise transmitted by you via homeformusic.app and the corresponding Circle community mobile application ("User Generated Content").

Member Conduct

You agree not to use the newsfeed nor any other part of the Service or the Site to upload, post, or otherwise transmit any User Generated Content or any other material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

Facility Terms and Conditions

Use of H.O.M.E. Facilities

Depending on the type of membership you purchase from H.O.M.E., you may have access to certain locations and facilities at certain times and at additional cost to use our facilities ("Facilities"). When using or visiting any of our Facilities, you will:

Use our Facilities responsibly and courteously
Only use our Facilities when and as permitted by us
Be responsible for any damage caused to our Facilities
Leave our Facilities in the state in which you found them
Not use any unlawful drugs, tobacco products while on the premises
Follow all requests of H.O.M.E. staff and employees

Insurance

Although H.O.M.E. will carry insurance, as a Member, it is strongly suggested that you carry a Renters Insurance policy to cover your own equipment while using our Facilities.

General Terms

The Service is operated by H.O.M.E. from its offices within the United States of America. These Terms constitute the entire agreement between you and H.O.M.E. and govern your use of the Service. The Terms and the relationship between you and H.O.M.E. shall be governed by the laws of the State of Tennessee. You and H.O.M.E. agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Davidson, Tennessee.

Copyright Infringement Notification

We respect the intellectual property rights of authors. To assist copyright owners, we have appointed an agent to receive notifications of claims of copyright infringement regarding materials available or accessible on, through, or in connection with our Site and services in compliance with Section 512 of Title 17 of the United States Code ("Copyright Act").
